AusPath Recruiter Platform Terms

ImportantThese Terms are commercial terms, not employment, migration, registration or legal advice. AusPath should have an Australian solicitor review them against its actual operating arrangements and Privacy Policy before publication. Nothing guarantees a candidate, employer, Job Order, placement, commencement, sponsorship, professional registration, skills assessment, migration eligibility, visa outcome, employer lead or revenue. Rights that cannot lawfully be excluded remain unaffected.
1. Agreement, authority and incorporated documents

By creating or using a Recruiter Pro workspace, accepting these Terms, entering an approved trial, paying a Platform Fee, purchasing additional Candidate Activations or AI credits, progressing a candidate, or requesting an AusPath service, the independent recruiter organisation (“Recruiter”, “you” or “your”) agrees to these Terms. The person accepting confirms that they are authorised to bind the organisation.

These Terms incorporate the applicable checkout or order confirmation, approved trial offer, published AI credit rules, Privacy Policy, candidate consent and visibility settings, Candidate Activation confirmation and any signed service agreement or statement of work. A transaction-specific checkout or signed agreement controls for that transaction where it expressly differs from these general Terms. Marketing copy does not override an accepted checkout, consent screen or signed scope.

Key definitions. “Recruiter Pro” or “Recruiter Pro Platform” means the AusPath-hosted recruiter CRM, recruitment workflows and connected recruitment infrastructure made available under these Terms. “AusPath Approved Recruiter badge” means the revocable trust badge issued by AusPath to an approved recruiter organisation while approval remains current. “AusPath Candidate” means a candidate participating in the AusPath candidate ecosystem. “Job Order” means a genuine employer role recorded in Recruiter Pro. “Candidate Activation” means the controlled candidate-specific progression event through which a candidate is activated against a genuine Job Order. “Successful Placement” occurs when the candidate accepts and signs the employer’s formal employment contract. “Successful Commencement” occurs when the candidate actually commences employment with the employer. “AI Recruiter Pro” means the bonus employer-prospecting capability described in clause 9. “AI Credits” are Platform units used for eligible AI-assisted actions under the published credit rules.
2. 14-day risk-free trial and transition to paid Recruiter Pro

AusPath may offer approved eligible recruiter organisations a 14-day risk-free trial of Recruiter Pro. The trial is intended for genuine recruitment businesses with real employer relationships and active or upcoming Job Orders. Trial approval is at AusPath’s discretion and may be subject to business verification, Job Order evidence, Platform limits and transaction-specific conditions disclosed before access.

Unless expressly included in the approved trial offer, the trial does not create an entitlement to consume paid Candidate Activations, obtain unrestricted candidate contact details, export the candidate network or bypass protected candidate progression. Any candidate-specific transaction or other charge presented and expressly accepted during the trial remains payable according to that transaction.

If the Recruiter chooses to continue after the trial, Recruiter Pro moves to the AUD $2,990 + GST monthly Platform Fee. If the Recruiter does not continue, trial access may end without creating a future monthly Platform Fee, subject to accrued transaction-specific obligations and clauses intended to survive.

3. Independent recruiter relationship, Recruiter Pro and AusPath Approved Recruiter badge

Independent relationship

The Recruiter remains an independent recruitment business responsible for its own staff, employer agreements, employer recruitment fees, representations, recruitment activity and compliance with applicable laws. Use of “Recruiter”, “Approved Recruiter” or participation in the AusPath network does not by itself create a legal partnership, joint venture, employment relationship or authority to bind AusPath.

Recruiter Pro — Powered by AusPath

Recruiter Pro is powered, operated and hosted by AusPath. Approved recruiter branding may appear in supported areas, but AusPath technology, infrastructure, branding elements, portals and AusPath-controlled URLs may remain visible. No custom domain, separately hosted instance, source-code licence or right to remove required AusPath attribution is included unless AusPath agrees in writing.

AusPath Approved Recruiter badge

After approval, AusPath may issue the Recruiter the AusPath Approved Recruiter badge for authorised display. The badge confirms only that AusPath has approved the organisation under its current due-diligence and participation process. It is not a government approval, employment-agent licence, labour-hire licence, migration authority, endorsement, guarantee of conduct or assurance of any candidate, recruitment, registration, sponsorship, migration, visa or employment outcome.

The badge remains AusPath property, is non-transferable and revocable, must not be altered or used by another organisation, and may be withdrawn if approval expires, information becomes inaccurate, the account is suspended or terminated, the Recruiter ceases to meet participation standards, or these Terms are breached. The Recruiter must stop displaying it when AusPath directs.

4. Recruiter approval, verification and access boundaries

AusPath may verify the organisation’s legal identity, business registration, genuine recruitment purpose, representative identity and authority, employer relationships, Job Orders, candidate-handling practices, licences and supporting evidence. The Recruiter must provide accurate, current information and notify AusPath of relevant changes.

AusPath may approve, reject, defer, condition, suspend or reinstate approval where reasonably necessary to protect candidates, employers, other recruiters, proprietary technology, security, legal compliance and the integrity of the AusPath network.

Candidate identity, contact details, documents and protected information remain subject to Platform permissions, candidate consent and workflow stage. Approval does not create unrestricted database access.

5. Included and purchased AI credits

Each paid monthly Recruiter Pro cycle includes 100 AI credits. Credits apply to eligible AI-assisted actions identified by AusPath, including supported AI matching, shortlisting, job-specific AI CV generation and other published AI actions. AusPath may also offer additional credit packs under the price and conditions displayed before purchase.

  • AI credits are workspace-bound Platform units with no cash value.
  • Credits do not purchase or unlock candidate contact details.
  • Ordinary navigation and manual CRM activity do not consume AI credits unless clearly disclosed.
  • Failed, empty, duplicate, suppressed or unsupported outcomes should not be charged as successful outcomes.
  • Actual use may appear in the workspace credit ledger.
  • Included monthly credits do not roll over unless AusPath expressly states otherwise.

Except where law or a transaction-specific promise requires otherwise, properly used credits and completed AI outcomes are not refundable. AusPath will correct verified duplicate or erroneous charges.

6. Job Orders, proprietary AI matching, shortlists and job-specific AI CVs

Candidate matching must be linked to a genuine employer and Job Order containing accurate role requirements, location, profession, mandatory criteria and positions available. The Recruiter must not create false opportunities to inspect candidates.

AusPath’s proprietary matching technology may analyse permitted candidate CV content, structured profile information, profession, skills, experience, pathway stage, Workforce Readiness Score, preferred location, availability and Job Order criteria. It may rank candidates and explain relevant strengths, gaps, missing information and confidence for recruiter review.

Before the permitted progression stage, live candidate results may be redacted. AI-generated or job-specific CVs must use recorded candidate information and must not invent qualifications, experience, registration, evidence or suitability. The Recruiter remains responsible for reviewing AI output and making lawful professional and hiring decisions. Matching, ranking, Workforce Readiness or an AI CV is not a guarantee of suitability, eligibility, availability or employment.

7. Protected candidate progression, interest and interviews

Recruiter Pro is a controlled recruitment environment, not an open candidate database. AusPath may use protected or redacted candidate information at early workflow stages and release additional information only when permitted by the applicable candidate consent, Job Order, Recruiter approval and progression stage.

  1. The Recruiter enters a genuine Job Order.
  2. Recruiter Pro may match and rank permitted candidate records against that role.
  3. The Recruiter selects candidates it wishes to progress.
  4. AusPath and/or the Platform may confirm candidate interest and availability.
  5. The selected candidate is activated against the Job Order under clause 8.
  6. AusPath supports candidate-side progression and interview coordination through the connected workflow.

The Recruiter must not scrape, harvest, export, independently solicit or retain protected AusPath candidate information outside the permitted workflow. Candidate interest or an interview does not guarantee employer selection, contract, sponsorship, visa approval or commencement.

8. Platform Fee, Candidate Activations, Successful Placement and Successful Commencement Fees

Included Candidate Activations

Each paid monthly Recruiter Pro cycle includes 10 Candidate Activations. An activation is candidate-specific and Job-Order-specific. Unless AusPath expressly agrees otherwise in writing, unused included activations do not have cash value, cannot be transferred or sold, and do not roll over to a later monthly cycle.

What Candidate Activation starts

Once a candidate is validly activated, AusPath connects the Recruiter, employer, Job Order and candidate within the supported workflow and may coordinate candidate-side progression, candidate information and available-document collection, interview progression and applicable international recruitment pathway activity. Where regulated migration advice or legal services are required, those services must be provided by appropriately authorised migration professionals under their applicable engagement and terms.

Successful Placement milestone

The AUD $999 + GST Successful Placement Fee is triggered when the candidate accepts and signs the employer’s formal employment contract. It is payable within 7 days of contract signing. Contract signing is a commercial fee milestone; it is not the end of AusPath’s agreed candidate-side support.

Successful Commencement milestone

The separate AUD $999 + GST Successful Commencement Fee is triggered when the candidate actually commences employment with the employer. AusPath’s agreed support may continue between contract signing and commencement through applicable sponsorship/visa coordination, progress tracking, candidate preparation and commencement support.

Recruiter’s employer fee

Under this offer, the Recruiter manages its employer relationship and keeps 100% of the employer recruitment fee it charges. The Recruiter’s employer fee is separate from AusPath’s Platform Fee, Candidate Activation charges and milestone fees. The Recruiter remains responsible for its employer agreement, invoicing, warranties, rebates, replacements and any obligations it gives the employer.

Withdrawal, replacement and non-guarantee

Any replacement activation credit or remedy is governed by the accepted transaction confirmation or service agreement. Unless expressly stated, an activation credit has no cash value and does not remove a later milestone fee if a replacement candidate reaches that milestone. Activation and support do not guarantee candidate continuation, registration, employer selection, sponsorship, placement, migration eligibility, visa approval or commencement.

10. AI controls, human review and service boundaries

AI functions operate only within the authorised user’s current workspace permissions and available data. The Recruiter remains responsible for instructions, approvals, lawful authority, recipients, external use of generated content and all professional, employment and hiring decisions.

  • AI output may be incomplete or wrong and requires appropriate human review.
  • AI must not invent candidate status, evidence, qualifications, employer interest, professional registration or migration eligibility.
  • AI does not make legal, migration, registration, sponsorship or final hiring determinations.
  • Unsupported or disconnected functions must not silently run or charge.
11. External connections, communications and provider terms

You authorise use of each connected email, calendar, CRM, job-board or other provider only within the permission you grant and the approved Platform action. You must hold the required account, subscription, authority and lawful basis and comply with provider terms.

You are responsible for lawful recipient selection, sender identification, consent or other lawful authority, content approval, unsubscribe facilities, suppression and compliance with applicable spam, privacy, employment, anti-discrimination and consumer laws. You must not use Recruiter Pro for deceptive messages, purchased-list spam, harassment, uncontrolled bulk messaging or unauthorised scraping.

Third-party providers may change APIs, permissions, prices, availability and rate limits. AusPath does not guarantee uninterrupted third-party access. External subscriptions and provider charges remain your responsibility unless expressly included.

12. Privacy, candidate consent and security

Each party must handle personal information lawfully, securely and only for authorised recruitment and service purposes. AusPath’s Privacy Policy explains its collection, use, disclosure, storage, overseas handling and individual-rights practices.

  • Recruiter access must be limited to authorised users who need it.
  • Candidate contact details remain protected through controlled workflows and are not sold or released as a standalone list.
  • Sensitive documents and migration-related information may have additional access restrictions.
  • The Recruiter must remove users whose authority ends and promptly report suspected compromise.
  • The Recruiter must not export, copy, disclose or retain candidate information beyond the permitted purpose.
  • Candidate consent, visibility, interest responses, document access and relevant revocations may be logged.

Protected AusPath Candidate data is not a recruiter-owned database.

13. Workspace administration, licensing and acceptable use

The organisation administrator is responsible for users, roles, billing authority, connections and settings. Each user must have a unique account and protect credentials.

AusPath approval is not a government licence, employment-agent licence, labour-hire licence, migration registration or authority to perform regulated work. The Recruiter must identify, obtain and maintain every licence, registration, permit and professional authority required wherever it operates.

You must not reverse engineer, disrupt, overload, probe, bypass controls, share accounts, introduce malicious code, access another workspace, scrape protected profiles, manipulate credits or activations, impersonate another person, discriminate unlawfully, create false Job Orders, circumvent fees or use the Platform unlawfully.

14. Platform cancellation, suspension, termination and accrued fees

Cancellation

The Recruiter may cancel future renewal of Recruiter Pro through available account controls or the published support channel. Unless the accepted order or law requires otherwise, cancellation ends the paid Platform entitlement at the end of the current paid period. Cancellation does not erase charges already incurred, a Successful Placement Fee already triggered by a signed employment contract, a Successful Commencement Fee already triggered by commencement, completed additional Candidate Activations, used AI credits or other accrued obligations.

Suspension

AusPath may restrict or suspend access where reasonably necessary because of candidate risk, suspected Platform or candidate abuse, privacy or security concerns, unlawful conduct, non-payment, credential compromise, licensing concerns, false or misleading information, false Job Orders, attempted circumvention of protected workflows or fees, or an actual or suspected breach of these Terms.

Termination

AusPath may terminate Recruiter Pro access, Recruiter status, badge permission and associated entitlements for material breach, fraud, candidate exploitation, deliberate privacy/security abuse, unlawful conduct, serious professional misconduct, non-payment, loss of required authority, materially false verification information or conduct creating a serious candidate, employer, legal, security or platform-integrity risk.

Termination does not erase accrued payment obligations, completed transactions, candidate consents, confidentiality duties, intellectual-property protections or provisions intended to survive termination.

15. Payments, GST, refunds and disputes

Unless expressly stated otherwise, published commercial amounts under these Terms are in Australian dollars and exclude GST. The Recruiter authorises AusPath and its payment provider to charge amounts expressly accepted for the monthly Platform Fee, additional Candidate Activations, Successful Placement Fees, Successful Commencement Fees, AI credits and other agreed services.

Refunds are provided where required by law, where an accepted transaction-specific promise applies, or where AusPath confirms a duplicate or erroneous charge. Change of mind does not ordinarily create a refund for an elapsed Platform period, completed activation, used credit, Successful Placement milestone, Successful Commencement milestone or completed service.

Billing disputes should be raised promptly through the published support channel with the relevant workspace, transaction and reason.

16. Service limits, consumer guarantees and liability

The Platform depends on internet access, third-party providers, user and candidate data, changing circumstances and human decisions. AusPath does not warrant uninterrupted availability, that every profile is complete, that every AI output is accurate or that Platform use will produce a particular commercial or recruitment result.

Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded. Where a statutory guarantee applies and liability may lawfully be limited, AusPath’s liability is limited, at its option, to resupplying the affected service or paying the reasonable cost of resupply.

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, or loss of profit, revenue, opportunity, goodwill or anticipated savings arising from the Platform. This does not limit liability that cannot lawfully be limited or liability for fraud, wilful misconduct, breach of confidentiality or unlawful misuse of personal information.

To the maximum extent permitted by law, AusPath’s aggregate liability arising from affected Platform services in a 12-month period is limited to the fees paid by the Recruiter for those affected services during that period. This cap does not apply where law prohibits it.

17. Intellectual property, candidate network, scoring and feedback

AusPath retains ownership of the Platform, software, source code, URLs and domains, infrastructure, portals, matching algorithms, workflows, AusPath branding, templates, scoring methods, Workforce Readiness methodology, candidate ecosystem and documentation. Recruiter Pro access does not transfer ownership of AusPath technology or the candidate network.

The Recruiter receives a limited, revocable, non-transferable right to use Recruiter Pro for authorised business recruitment purposes while the account remains in good standing. The Recruiter must not copy, extract, resell, reverse engineer or use Platform data or outputs to recreate a competing candidate database, matching system or scoring method.

The Recruiter retains ownership of its pre-existing business name, logo, content and recruiter-controlled records, subject to candidate rights and permissions required for service delivery.

18. Changes, notices and governing law

AusPath may update these Terms for legal, security, provider, pricing or product changes. Material changes will receive reasonable advance notice and apply prospectively. A pricing change does not retrospectively alter a fee already triggered under the accepted terms applying to that transaction.

Operational notices may be delivered in Recruiter Pro or to the administrator email. The Recruiter must keep contact details current.

These Terms are governed by the laws of Victoria, Australia, and the parties submit to courts with jurisdiction in Victoria, subject to any mandatory law or right permitting proceedings elsewhere. If a provision is unenforceable, it is read down or severed without affecting the remainder. Failure to enforce a right is not a waiver.

19. Contact and continuing acceptance

Questions, cancellations, billing disputes, privacy requests and notices may be submitted through the contact method published on the AusPath website or the Recruiter Pro support channel.

By entering the trial, subscribing to Recruiter Pro or continuing to use the Platform after these Terms take effect, the Recruiter confirms that it has read, understood and accepted them.
